As such, CAOBI.EU is not required to maintain the records specified in 18 U.S.C. § 2257 with respect to content uploaded by third-party users. The responsibility for compliance with the record-keeping requirements of 18 U.S.C. § 2257 rests with the individual producers and uploaders of such content.

2. User-Uploaded Content and Age Certification

All content appearing on CAOBI.EU is uploaded by registered users of the platform. By uploading content, each user represents, warrants, and certifies that:

• All persons depicted in the uploaded content were at least eighteen (18) years of age at the time the visual depictions were created, or were over the age of majority in the jurisdiction where the content was produced, whichever is greater.
• The uploader has verified the age of all persons depicted in the content and maintains records of such verification as required by applicable law.
• The uploader possesses all necessary rights, consents, and releases to upload and distribute the content on the platform.
• The content does not depict any person under the age of eighteen (18) in any sexually explicit conduct, and does not otherwise violate any applicable law.

CAOBI.EU requires all uploaders to affirm age compliance before and during the upload process. Users who upload content in violation of these requirements are subject to immediate account termination and referral to the appropriate law enforcement authorities.

3. Records Maintained by Content Creators and Producers

The original producers and creators of content appearing on CAOBI.EU are solely responsible for maintaining the records required under 18 U.S.C. § 2257, including but not limited to:

• Verification of the identity and age of all performers depicted in visual depictions of sexually explicit conduct.
• Maintenance of individually identifiable records pertaining to every performer, including legal name, date of birth, and any aliases used.
• A copy of a government-issued identification document for each performer verifying their age at the time of production.
