DMCA Notice & Takedown

CAOBI.EU respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This page describes the procedures for reporting alleged copyright infringement on our platform and the counter-notification process available to users who believe content was removed in error.

Operator: CAOBI / Bohemia Media s.r.o.Designated Agent: dmca@caobi.euEffective: 2026-03-20

1. DMCA Compliance Overview

CAOBI.EU is committed to complying with the Digital Millennium Copyright Act and other applicable intellectual property laws. We respond promptly to valid notifications of alleged copyright infringement that conform to the requirements of 17 U.S.C. § 512(c)(3).

Upon receipt of a compliant DMCA takedown notice, we will expeditiously remove or disable access to the allegedly infringing material. We will also notify the user who uploaded the content and provide them with an opportunity to submit a counter-notification if they believe the removal was made in error.

2. How to Submit a DMCA Takedown Notice

To file a valid DMCA takedown notice with our Designated Agent, your written notification must include all of the following elements as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (such as the URL of the page containing the material).
  4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an email address at which the complaining party may be contacted.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please send your DMCA takedown notice to our Designated Agent at the contact information provided in Section 4 below.

3. Counter-Notification Process

If you believe that material you posted on CAOBI.EU was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with our Designated Agent. Your written counter-notification must include the following elements as required by 17 U.S.C. § 512(g)(3):

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled (such as the URL).
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside the United States, any judicial district in which CAOBI may be found), and that you will accept service of process from the person who provided the original takedown notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. If the original complainant does not file a court action seeking to restrain the allegedly infringing activity within ten (10) business days, we will restore the removed material in accordance with the DMCA.

4. Designated Agent Contact Information

All DMCA notices and counter-notifications should be directed to our Designated Agent:

Designated Agent: CAOBI DMCA Agent

Organization: CAOBI / Bohemia Media s.r.o.

Email: dmca@caobi.eu

Website: caobi.eu

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, CAOBI has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.

CAOBI may also, at its sole discretion, limit access to the site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement. Factors considered may include the number of infringement notices received, the nature of the infringing activity, and the user's response to such notices.

6. Good Faith and Perjury Notice

Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.

Please ensure that you have a good faith belief that the material at issue is infringing before submitting a takedown notice. Similarly, please ensure that you have a good faith belief that material was removed in error before submitting a counter-notification. If you are unsure whether material infringes your copyright, we strongly recommend consulting with an attorney before filing a DMCA notice.

Misuse of the DMCA takedown process to suppress content that does not infringe your copyright may result in liability under 17 U.S.C. § 512(f) and may also constitute a violation of our Terms of Service.
